Terms of use
project ofk is software that runs an AI persona from a phone number you own. It answers texts, follows up with people and sends links to media you sell on Mint Fan. It is run by whatsa company. By applying for or using an account you agree to these terms.
The short version. You bring your own phone, SIM and AI keys, and you are responsible for every text your persona sends. Only talk to adults, only text people who texted you first, never use a real person's likeness without their permission, and never stop your persona from saying it is an AI when someone sincerely asks.
1. Accounts
project ofk is invite only. An account is opened when we approve it, and the same login works on project ofk, Mint Fan and phonenumber.site. You must be 18 or over. Keep your password private and turn on the authenticator code in Settings. You are responsible for everything done with your account.
2. Your phone, SIM and number
Texts are sent and received by the ofk sms app on an Android phone you own, using a SIM you own or are allowed to use. Your carrier's terms and charges apply to every text. If your phone is off, out of signal or out of credit, texts wait or fail; we cannot send them for you.
3. Your AI keys and costs
Your persona runs on AI accounts you set up yourself (OpenRouter and Anthropic, and WaveSpeed if you make pictures or video). You pay those providers directly and their terms apply to your use. We store your keys encrypted and only use them to run your own account.
4. Who your persona can talk to
- Adults only. Never use project ofk to talk to anyone under 18. If someone says they are under 18 your persona ends the chat, and you must not continue it by hand.
- People who reached out first. Your persona replies to people who texted your number. Do not upload lists of numbers or text people who never contacted you. Anti spam laws (in Australia, the Spam Act 2003) apply to you as the sender.
- Stop means stop. When someone asks not to be texted again, block them and leave them alone.
5. Honesty about AI
Every persona says it is an AI character when someone sincerely asks, and never claims to be a human. This is built into project ofk and applies to every account. You must not remove it, prompt around it, or tell people by hand that they are talking to a real person when they are talking to the AI.
6. Real people and likeness
If a persona is based on a real person, or uses their name, photos, voice or likeness, you must have that person's clear permission and keep a record of it. Personas must never depict anyone under 18. Reference photos you upload must be ones you have the right to use.
7. What is not allowed
- Anything illegal where you or the people you text live.
- Any content involving minors, and anything non consensual, violent or exploitative.
- Fraud, scams, threats, harassment, or pretending to be someone you are not without their permission.
- Promising things you will not deliver. If someone tips for an item or a custom request, you deliver it.
- Trying to reach another account's data, overloading the service, or getting around its limits.
8. Selling and payments
Media is sold through Mint Fan and paid out to your own Stripe account. The Mint Fan terms cover buying, selling, refunds and takedowns, and Stripe's terms cover payouts. Prices, discounts and tips your persona offers are your offers.
9. Your data and the people you text
project ofk stores your chats, contacts, notes and settings so your persona can remember people. Message text and names are encrypted at rest; phone numbers are kept plain because texts are routed by them. Only your account can see your data. We do not sell it or use it to train AI.
You decide who your persona talks to, so you are responsible to those people for how their messages are used. If someone asks you to delete their messages, block and remove them from your dashboard, or ask us and we will delete them.
10. The service
project ofk is provided as is. AI can make mistakes, texts can fail, and features can change. Read what your persona sends and step in when it gets something wrong. We are not responsible for what your persona or your AI providers produce, for carrier or provider outages, or for lost sales, to the extent the law allows. Nothing in these terms removes rights you have under the Australian Consumer Law.
11. Ending
You can stop at any time: switch your personas off, remove the app from your phone and ask us to close your account. We can suspend or close an account that breaks these terms, puts people at risk, or that we need to close by law. When an account is closed its project ofk data is deleted.
12. Changes and contact
We may update these terms; the date at the top shows the latest version, and using project ofk after a change means you accept it. These terms are governed by the laws of Queensland, Australia. Questions go to contact@whatsacompany.com.
